Additional Information
Holidays and Breaks: When a parent exercises their holiday or break parenting time, the usual alternate weekend parenting time is suspended. When the holiday or break parenting time ends, the alternate weekend parenting time picks up, as if the holiday or break had not occurred. This may result in one parent having two or more weekends in a row.
Mother’s Day and Father’s Day: The child(ren) shall be with the mother every Mother’s Day from 9:00 a.m. until 6:00 p.m. and with the father every Father’s Day from 9:00 a.m. until 6:00 p.m.
Parent’s Birthday: The child(ren) shall be with their parent on the parent’s birthday from 4:00 p.m. to 8:00 p.m. If the parent’s birthday is on a holiday, the parent may pick an alternate day to exercise birthday parenting time and give 30 days’ notice to the other party and the Friend of the Court.
Winter (Christmas) Break:
- Summer parenting time can be taken in any manner selected by the non-custodial parent, as long as it is exercised in one-week increments. This means that summer parenting time should start and end on the same day of the week, at the same time of day (i.e. Monday at 6:00 p.m. to Monday at 6:00 p.m.)
- The non-custodial parent shall submit a summer parenting time schedule in writing to the custodial parent before May 1st of each year, with a copy to the Friend of the Court.
- Failure to submit a written schedule will result in the custodial parent choosing the non-custodial parent's summer parenting time.
- Regular parenting time is suspended during summer parenting time.
- Holiday parenting time takes priority over summer parenting time, so the non-custodial parent should take note of the Fourth of July holiday when selecting summer parenting time dates.
Transportation: Transportation to and from parenting time shall be shared equally by each parent. This means that, unless otherwise ordered, each parent is responsible for picking up the child(ren) at the start of his/her parenting time. Note: When parenting time does not include an overnight, the parent exercising the parenting time shall be responsible for all transportation.
A 30-minute delay in pick up/drop off of the child(ren) shall be allowed for unforeseen circumstances only.- A parent may choose to have a properly licensed adult, who is familiar to the child(ren), provide transportation for parenting time.
- Unless your court order prohibits, either parent may take the child(ren) out-of-state for vacation.
Clare County Reasonable Rights of Parenting Time For Younger Children
This schedule applies ONLY if you and the other party are specifically ordered to follow the Clare County Reasonable Rights of Parenting Time for Younger Children.
The non-custodial parent shall also have three (3) visits per month for six hours each. If the parents cannot agree, parenting time shall be exercised the first three (3) Saturdays of each month from 12:00 p.m. (noon) until 6:00 p.m.
Court’s Philosophy Regarding All Parenting Time
Parents must attempt to resolve all disputes by first talking directly with each other. Treat the other parent as you would like to be treated and do your talking outside the presence of the child(ren). “We cannot talk to each other” IS NOT AN ACCEPTABLE EXCUSE for avoiding contact with the other parent.
The Friend of the Court has the authority to interpret and make determinations for purposes of enforcement. The parties may mutually agree to allow different parenting time; however, the agreement will not be enforced by the Friend of the Court.
